Terms & Conditions for Four Prong Herbs

1. Acceptance of Terms

By accessing and purchasing from Four Prong Herbs (“we,” “our,” “us”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please stop using our website immediately.

2. Eligibility

You must be at least 18 years old or have the consent of a parent/guardian to make purchases on our site.

3. Products & Services

  • We make every effort to display product details accurately. However, colors, sizes, and descriptions may vary slightly.

  • We reserve the right to modify or discontinue products without notice.

4. Pricing & Payment

  • All prices are listed in U.S. Dollars[USD] and exclude applicable taxes as stated.

  • We accept payments via the payment methods listed at checkout.

  • You agree to provide accurate billing and payment information.

  • Orders are only confirmed once payment is successfully processed.

5. Shipping & Delivery

  • Shipping costs and estimated delivery times are displayed at checkout and/or our Shipping Policy Section.

  • We are not responsible for delays caused by carriers, customs, or unforeseen events.

  • Risk of loss passes to you upon delivery to the shipping address provided.

6. Returns, Refunds & Exchanges

  • You may initiate returns on eligible items within 3 days of receipt in their original condition. Items considered nonperishable must be received within 15 business days of initiating a return to be eligible for a refund. Items considered perishable (which includes all fresh/dry roots and milled root powders) must be received within 5 business days of initiating a return to be eligible for a refund.

  • Certain items (e.g., perishable goods, custom orders) are as a general rule non-returnable.

  • Refunds will be processed to the original payment method within 10 business days after inspection.

7. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.

  • We reserve the right to suspend or terminate accounts for violations of these Terms.

8. Intellectual Property

All content, trademarks, and designs on this site are owned by or licensed to us. You may not copy, reproduce, or distribute without written permission.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of our site or products.

10. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, or supply chain disruptions.

11. Dispute Resolution & Arbitration

  • Informal Resolution: Before filing a claim, you agree to contact us at fourprongherbs@gmail.com to attempt to resolve the dispute informally within 30 days.

  • Binding Arbitration: If we cannot resolve the dispute informally, it will be settled by binding arbitration under the rules of the Uniform Arbitration Act in Kentucky, USA.

  • No Class Actions: You agree to resolve disputes individually and not as part of a class, consolidated, or representative action.

  • Governing Law: This clause is governed by the laws of Kentucky, USA.

12. Governing Law

These Terms are governed by the laws of Kentucky, USA., without regard to conflict of law rules.
